OVERVIEW

Welcome to Timeless Events! The terms "we," "us," and "our" refer to Timeless Events. Timeless Events operates this shop and website to provide you with a curated shopping experience (the "Services"). Timeless Events is hosted on Shopify.

By visiting or using our Services, you agree to these Terms and our Privacy Policy at https://timelessevents.co/policies/privacy-policy. If you do not agree, you should not use our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you confirm that you are of legal age in your state or province of residence and have consented to minor dependents using the Services on your devices.

To use the Services, you may be required to provide information such as your email address, billing, payment, and shipping details. You represent that all information provided is accurate, current, and complete.

You are solely responsible for the security of your account credentials and all activity in your account. You may not transfer, sell, assign, or license your account to any third party.

SECTION 2 – OUR PRODUCTS

We make every effort to accurately display our products. However, colors and appearance may vary depending on your device and settings. We do not warrant that product quality will meet your expectations.

All product descriptions may be changed at any time without notice. We reserve the right to discontinue products or limit quantities at any time.

Digital Products: For digital products (e.g. downloads, digital files), delivery occurs after purchase via link or email. The right of withdrawal expires upon accessing the download link pursuant to § 356 para. 5 BGB, provided the customer has given explicit prior consent.

SECTION 3 – ORDERS

When you place an order, you are making a purchase offer. Timeless Events reserves the right to accept or reject orders at its sole discretion. Your order is only accepted once Timeless Events confirms acceptance.

Please review your order carefully before submitting, as cancellation requests after acceptance may not be possible.

You confirm that your purchases are for personal use and not for commercial resale.

In accordance with § 356a BGB, you have access to an electronic withdrawal function at https://timelessevents.co/pages/widerruf-formular. This is available continuously and without prior registration throughout the entire withdrawal period.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged is the price in effect when the order is placed and will be listed in your order confirmation email. Unless stated otherwise, prices do not include taxes, shipping, handling, customs, or import duties.

You agree to provide accurate and complete payment information and to keep it current. You represent that (i) your card details are accurate and complete, (ii) you are authorised to use the card, (iii) your card issuer will cover the charges, and (iv) you will pay all charges including shipping and applicable taxes.

SECTION 5 – SHIPPING AND DELIVERY

We are not responsible for shipping or delivery delays. Delivery times are estimates and not guaranteed. We are not liable for delays caused by carriers, customs, or events beyond our control.

Risk of accidental loss or damage transfers to you only upon actual delivery of the goods.

SECTION 6 – INTELLECTUAL PROPERTY

All content within the Services, including trademarks, logos, text, images, graphics, videos, and their arrangement, is owned by Timeless Events or its licensors and protected by applicable law.

You may use the Services only for personal, non-commercial purposes. Reproduction, distribution, or modification without prior written consent is not permitted.

You may have access to optional third-party tools provided "as is" without warranties. Use is at your own risk. Review and accept any third-party terms before use.

The Services may contain links to third-party websites. We are not responsible for their content or policies. Access is at your own risk.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Timeless Events operates on Shopify. All purchases are directly with Timeless Events. Shopify is not responsible for transactions or resulting damages.

SECTION 10 – PRIVACY

All personal data is subject to our Privacy Policy at https://timelessevents.co/policies/privacy-policy and may also be subject to Shopify's Privacy Policy.

SECTION 11 – FEEDBACK

By submitting feedback, you grant Timeless Events a worldwide, royalty-free licence to use, reproduce, publish, and distribute it for any purpose. This does not affect consumers' right to leave reviews on third-party platforms.

SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS

We reserve the right to correct errors or inaccuracies in product descriptions, pricing, or availability at any time and to cancel orders where necessary.

SECTION 13 – PROHIBITED USES

You may use the Services only for lawful purposes. Prohibited uses include illegal activities, infringement of third-party rights, uploading malware, spamming, or bypassing security measures. We may suspend or terminate accounts for violations.

SECTION 14 – AGENTS

Any software or service acting autonomously on your behalf must correctly identify itself at all times and may not bypass security measures. Agents must indicate in the user-agent string that the request originates from an agent.

SECTION 15 – TERMINATION

We may terminate your access at any time without notice. You remain responsible for all payments due through the termination date. Sections on Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, and Indemnification survive termination.

SECTION 16 – DISCLAIMER OF WARRANTIES

Information provided through the Services is for general informational purposes only. We make no warranties regarding its accuracy or completeness.

Nothing in this section affects consumers' statutory warranty rights under German law (§§ 434 ff. BGB), which provide a two-year warranty period from delivery.

To the fullest extent permitted by law, Timeless Events and its affiliates are not liable for any direct, indirect, incidental, or consequential damages arising from use of the Services or products purchased through the Services.

This limitation does not apply to damages resulting from injury to life, body, or health, gross negligence, intentional misconduct, or mandatory statutory liability.

You agree to indemnify Timeless Events, Shopify, and affiliates from all claims, losses, or expenses arising from your violation of these Terms, applicable law, or third-party rights.

SECTION 19 – SEVERABILITY

If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.

SECTION 20 – WAIVER; ENTIRE AGREEMENT

Failure to enforce any term does not constitute a waiver. These Terms, together with all published policies, constitute the entire agreement between you and us.

SECTION 21 – ASSIGNMENT

You may not assign your rights or obligations without our prior written consent. We may assign these Terms without your consent.

SECTION 22 – GOVERNING LAW

These Terms are governed by German law, excluding the UN Sales Convention. Consumer protection laws of your jurisdiction may apply where they provide stronger protections.

SECTION 23 – HEADINGS

Headings are for convenience only and do not affect the interpretation of these Terms.

SECTION 24 – CHANGES TO TERMS

We may update these Terms at any time. The current version is always available on this page. Continued use of the Services after changes constitutes acceptance.
